Alaska Attorneys for Bicycle Accidents

Statistically, there is a bicyclist fatally injured every six hours in the U.S. The injuries associated with bicycle accidents are often more serious, since bicyclists have limited safety clothing or protection that they wear while cycling. The most common type of bicycle accident related injuries are head injuries including concussions and traumatic brain injuries. These injuries account for the vast number of injuries and deaths associated with bicycle accidents. Put simply, a bicycle is no match for a car, truck or SUV.

Alaska has municipal laws set in place that govern bike usage and also has laws provided for in the Alaska Administrative Code that govern bicycle rider conduct. Some provisions of this Code deal with the bicycle right of way laws, which include:

  • Bicycle riders operating a bicycle on a road way have all the rights and duties that apply to drivers of any other vehicle
  • Bicyclists are required to ride at as far to the right as practical
  • Bicyclists must not impede traffic by riding more than two abreast on public roads
  • When a shoulder is maintained in good condition, bicyclists are required to use it.

Common causes of bicycle accidents are distracted, drowsy or impaired drivers as a result of poor visibility or aggressive driving. Therefore, in most if not all bicycle accidents there is a negligent, distracted or impaired driver who fails to look both ways when driving from a stop, who turns directly in front of a bicyclist or who fails to yield at an intersection.
